1. Agreement

These Terms of Service (“Terms”) govern your use of the website at business.creatingitright.com and any consulting, advisory, setup, or implementation services (“Services”) provided by Creating It Right, owned and operated by Toni V. McElroy, M.Ed. (“we,” “us,” “our”). By using our website or engaging our Services, you agree to these Terms.

2. Services

We provide small business development consulting, including business structure guidance, online visibility setup, Google Business Profile optimization, website creation, and growth systems. Specific deliverables, timelines, and pricing are defined in your individual proposal or invoice.

3. No Legal, Tax, or Financial Advice

Information shared through our Services — including guidance about LLC setup, EIN registration, banking, or compliance — is for general business development purposes only and is not legal, tax, accounting, or financial advice. You are responsible for consulting licensed professionals before acting on any recommendation.

4. Client Responsibilities

• Provide accurate, complete, and timely information
• Respond to requests required to keep your project moving
• Maintain ownership of and access to your accounts and credentials
• Pay invoices on time per the agreed schedule

5. Payments

Payment terms are outlined in your proposal or invoice. Most projects require a deposit before work begins. Late payments may pause work and incur fees. See our Refund Policy for cancellations and refunds.

6. Deliverables & Ownership

Upon full payment, you own the final deliverables specifically created for your business (e.g., your website, profile content). We retain ownership of underlying frameworks, templates, and methodology, and may use anonymized results in case studies or marketing.

7. Results Disclaimer

We work hard to help your business grow, but we do not guarantee specific rankings, leads, revenue, or outcomes. Results depend on many factors including your market, effort, and execution.

8. Confidentiality

Both parties agree to keep non-public business information shared during the engagement confidential and to use it only for the purpose of delivering Services.

9. Limitation of Liability

To the fullest extent permitted by law, Creating It Right’s total liability for any claim arising from the Services is limited to the amount you paid for the specific Service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate an engagement with written notice. Fees for work completed up to the termination date are due. See the Refund Policy for refund eligibility.

11. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Alabama.

12. Changes

We may update these Terms from time to time. Continued use of our website or Services after changes are posted constitutes acceptance of the updated Terms.
